Ashley Furniture Class Action Alleges Deceptive Pricing Scheme - Top Class Actions

Ashley Furniture Industries LLC faces a false advertising class action lawsuit alleging the furniture chain dupes customers with fictitious “original” prices, leading them to falsely believe they are purchasing furniture at bargain prices.

Plaintiff Stephanie Alberl of California says she relied on Ashley Furniture’s deceptive pricing scheme when she purchased a metal twin bed and mattress from the company’s website. The twin bed was listed at a sale price of $96.99 with a reference price listed at $159.99, according to the Ashley Furniture class action lawsuit.

Aberl alleges she decided to purchase the metal twin bed because she believed the discounted price would not last long, and she believed she received a significant bargain of nearly 40% off the regular price of the bed.

“However, this product was never offered for sale at the original price listed on Ashley Furniture’s e-commerce website and certainly not within the 90 days preceding [Aberl’s] purchase,” the deceptive pricing class action lawsuit alleges. “Nor was it listed for sale at the full price in an Ashley Furniture brick and mortar store.”

The Ashley Furniture class action lawsuit explains that false reference pricing occurs when a seller lists a fake “original” price for a product and offers the product at a significantly lower “sale” price to entice bargain hunters to purchase the product.

This type of deceptive pricing “artificially inflates the true market price for these products by raising consumers’ internal reference price and in turn the value consumers ascribe to these products,” the Ashley Furniture class action lawsuit says.

Retailers are thus able to sell products at prices above their true market price and value, leaving customers to pay inflated prices, according to the deceptive pricing class action lawsuit.

The Ashley Furniture class action lawsuit asserts claims for violations of California’s unfair competition laws, false advertising laws and the California Consumer Legal Remedies Act.

Aberl filed the deceptive pricing class action lawsuit on behalf of herself and a proposed class of people in California who purchased one or more products from the Ashley Furniture website that were advertised at a discount from an advertised reference price who have not received a refund or credit for their purchase(s).

Ashley Furniture has also faced allegations that it failed to list promised delivery dates on sales documents in violation of New Jersey state laws.

I purchased items starting in 2019 and 2020. I paid for warranty on items purchased. Contacted Ashley on this matter. Sent pictures of defective items to date though several contacts no resolution or contact was made accept sending me a number in a email (unknown as to for verification). Never again purchasing from Ashley’s Furniture. Prices don’t go back to regular price, they are year round sales. Delivery took forever. Furniture is not the highest quality, so it does damage very easily. & their “warranty” is crazy

I purchased a counter height dining room table with 4 pub style stool chairs and was promised I would receive it within 2 weeks. Didn’t receive it for months with each month I called to see if my set would be delivered as promised, the delivery date was pushed out another month. This was for each time I called and I finally received it 7 months after the purchase.

I purchased a living room set from Ashley furniture on 9/8/21. I was told they deliver to my area once a month, and that I would receive my furniture by the end of October at the latest. I received 3 of 8 pieces 6 months later. And still waiting on the rest 11 months later. I was recently told one is no longer available. I need help with this. Add me to the list.

Please add me.. I just bought a sectional. Last year in Oct 2021. I just got it 3 weeks ago. I have all the texts, paperwork etc. Also they said it was being made in Texas. It’s used, I believe it is the floor model. It’s dirty &it was not plastic covered whenthey delivered it. The cushions are flat in two areas & trust me it’s used… I’m really upset… & $1,700.. down the drain…. I put a down over 1 year ago… .

Please include me. I purchased a beautiful sofa bed. The delivery was fine BUT, the so called mattress is only 1 inch thick. No one can sleep on that; now I have to purchase a mattress. If I had only wanted a sofa than I would have ordered that and not a sofa bed.

Please add me! Not only was I over, the furniture was garbage! Started falling apart after a few months. Ashley told me yo call the warranty company, and the warranty company tells me to call Ashley! Infuriating! Now it’s past the 12 month manufacturer warranty and the extended warranty I purchased for $500 will cover no damages because they weren’t reported within 30 days. It’s bullshit!

PLEASE ADD ME!! We bought over $9000.00 worth of furniture in Snellville GA back in Feb 2022. We were told it would take 6-8 weeks to come in. We were having a house built in TN & figured it would be better to purchase now. We were told that with the President sale & added “friends & family discount” we would saved over $4000.00. We would have to u-haul it all up to TN once it was delivered to our daughters house where we were staying in GA. (Different warehouse, we were told) With a savings like that we decided to go ahead & order it this way by the time our house was ready at the end of May we would have all our furniture. We only received part of it by May 31st. We have 6 dining room chairs without the table, the server or the bar stools to match. We have our two dressers without our headboard, footboard, bed rails or 2 nightstand. We did receive all of our living room furniture. Now some of our furniture will be “in June” & some will be “in Aug”. Every time I call it’s delayed further. We have already spent $350.00 moving the furniture we did get up to TN. Every time I call customer service they send an email to the manager of the Snellville store, will no reply. I have texted & called my salesman countless times & every time I’m told the manage will call me. Still no call. I can’t call from my phone or my husband’s because it’s associated with an order & goes to customer service who will not put me through to the store. The price of our furniture never increased after the end of “the President Sale” as told to us. I’m getting ready to call Ashley Headquarters. If no solution is agreed upon I will be seeking legal action.

In December of last year We purchased living room furniture from Ashley Furniture at Hattisburg, Miss. We were told it would be 12 to 16 weeks before delivery and that they would keep in touch. We waited 12 weeks no response from the store. I called the store, was told furniture will arrive in 4 more weeks. After 4 weeks I called was told will arrive June 23. I’m writing this just two days before June 23rd. I’m sick of waiting with no results, If I don’t get my furniture On June 23rd I’m demanding a refund of the total amount paid. If Ashley refuses to return my money I’m filing legal charges against them. I will not do business with Ashley ever again.

Add me please. Bought $6000 worth of furniture the first of February. Got part of it in April. They have another part in the warehouse but won’t deliver unless we pay for it. They said they were waiting for the last part to come in to deliver all at one time. It was supposedly free delivery. The day we purchased the sales person was wonderful. Oh but after I called to to get status it was like the devil came out!!! They keep pushing back the date of when we will get the rest of our stuff. The one piece we bought was a tv stand that was in the store. There was a price tag on it that showed $150 less than what she wrote up for us. She said it has gone up and they didn’t change the tag. Please add me. The store here in Chesapeake Virginia showed me their delivery dates of June 6, I explicitly asked all pieces to and entire bedroom set. Because my son is leaving and the store greeter told me all furniture would take 16 weeks. The sales rep that helped us showed us the computer screen 3 times. We purchased and left. He said I will call you tomorrow with updates. It’s been a week, never heard from him, I went in the store today and now our furniture is coming in 4 separate shipments in Aug. I feel like we have been deceived and lied to just to get a sale.

False advertising and absolutely no customer service here in Katy, TX. They advertise their furniture is made in USA but I my dresser mirror was delivered in a box plainly marked “Made In Vietnam.” Also, absolutely no customer service from this store, I ordered a complete bedroom set consisting of upholstered bed frame, box springs, two bedside tables, chest of drawers, and dresser with framed mirror. The salesman sent me an email with his contact information. Neither the phone number or email address works. He must have quit because I’ve been to the store several times to try to catch him and he’s never there and no one in the store knows his schedule. So far I have received one delivery with box springs, chest of drawers, and mirror for dresser. I have had three delivery notices which I confirmed back, for delivery of my bed frame, but so far no bed frame has been delivered. No way to check on delivery of anything. All you get is ringing phones and eventually a VM which no one in the stores knows who listens to or who is responsible for making call backs. What a crock, absolutely no accountability! I will never make another purchase at any Ashley Furniture HomeStore. Can a Texan join the CA class action lawsuit?

They also don’t have much furniture in their warehouse. In addition to furniture made in Vietnam, every piece of furniture I was interested in was not in stock, there was a wait time on everything.

I went into a store to browse for new sofas. Ended up buying a set, costing $4521 and some change. I paid in full, then even threw in “free” gas cards & gift cards totaling $500. When I got home, I went onto their website to show my mom and saw that the sofas I’d chose were 50% cheaper online than the store. I went back the next day and the manager was assisting another customer. The way he was treating that customer was not good and then when it was my turn, he thought he was going to give me a hard time too. He admitted that his reps should have price matched it since their own website reflected a much lower price. I asked for a refund and was told that the systems were down and that it would be processed later that day. I got an email notifying me that the return was processed on May 30th when I had gone in on the 19th to purchase and then returned on the 20th to cancel and get a refund. Like I told the manager at the Torrance, CA store (Edgar) his store’s business practices are unscrupulous. Please add me.

I have been fighting them for weeks regarding a refund. They have my money & I have no furniture that I paid for. Since I live in Texas I filed a complaint with the Consumer Protection Bureau to have all stores in Texas audited for unpaid refunds. In Texas the business has 7 working days to pay a refund or they are in violation of CPB laws & will be subject to paying 4.25% interest including the refund for every day they are in violation. I am also writing an article to send to every newspaper & media TV station in every city that Ashley has a brick & mortar store stating my story & warning customers NOT to do business with such a shady company. Customer service is non existent because they use the excuse that most stores are independently owned & therefore you have to deal directly with that store you have an issue with, which is a joke because they are all mismanaged by employees that are NOT professional enough or smart enough to handle the customers issues & will just tell you to take your issue up with your bank or credit card for a refund. The manager at the Wichita Falls, Texas store is from some foreign country & his name is so hard to say & spell he just goes by MD. Really!! I paid 465.45 on 4/29/2022, canceled my order 5 days later on 5/4/2022 because they wouldn’t work with my schedule for delivery & refused to let us come pick the one piece of furniture I paid for up in our own truck. It is now 5/24/2022 & still NO refund so they have my money & my furniture!!! The county we live in has had a literal population explosion with 35 developments being built with anywhere from 75 homes up to 10,000 homes per development, which gives me the opportunity to give the builders of these developments a printed story of Ashley’s shady practices so the 40,000 to 50,000 potential furniture customers will be warned NOT to purchase their furniture for their homes at Ashley’s. I will NOT stop until I get my refund, Ashley’s is fined & made to pay restitution to customers who have been duped by Ashley’s in their various scams to gain access to customers hard earned money. It makes me physically ill to see Todd Wanek brag about his company when he clearly doesn’t have a clue nor does he care what he is doing to honest, hardworking Americans. Also Ashley’s customer service isn’t even handled in the U.S., it is serviced in the Philippines by people that can barely speak English much less understand our issues. AGAIN, cheap company, hijacked prices & refund lies. The DOJ needs to close every store until Todd Wanek is made to clean up his dirty laundry & has paid restitution for his illegal business activities he is forcing on the American people.

Add me too. I went to buy a bed that Would be comfortable because I suffer with Multiple sclerosis, fibromyalgia. I told the sales lady what I needed. When I thought the bed I laid on was what I was going to recieve. It was as hard& caused me more pain. It was a tempurpedic. The 1st night it’s so hard and you cant even roll over because it’s so hard isn’t fluint like the bed in store. Called told me to jump on it, break it down with my knees & 30 day’s it should be better. My body can’t do that. Please add me to this. Ordered 04/22/22 King Bedroom suite – 2 night stands, 2 drawer chests, king headboard and foot board, mattress and adjustable base. Bedroom Suite was delivered on 05/07/22 which I paid an extra $200.00 to have it delivered. Mattress and adjustable base has yet to be delivered. They had it in stock when I purchased it what I was told by Nikki. They gave me these dates 05/17/22, 05/20/22, 05/21/22 and now as of 05/19/22 they are telling me 06/01/22 which will also change I am sure they are freaking liars and scum from the bottom of my shoe. They also will not give me credit due to me financing all of it. They also will not upgrade the products or check other stores. I currently have my queen mattress set sitting on a king bed frame. Ashley furniture over billed us for livingroom furniture – which all pieces are damaged & sit in our house for 6 months, they told us, once in your house its yours & they dont take it back – its yours, 6 book cases we waited for 6 months. They said we had to assemble them. They never told us that when we bought them. We wanted them the way we saw them in the show room. We argued for months, they say what they deiver is ours, they do not take back anything, however they did take back all 5 book cases and still billed us for all 5 and refuse to credit our money back and want us to pay the bill. We paid them $1000 up front. We only owe them $1000 more. Yet our bill is above and beyond the purchase and also has the book cases on the bill as well as additional charges they tagged on saying that was the cost. We still have damaged couch, love seat, ottoman, chair they willnot give us show room condition furniture. Its all damaged. They have hung up on us for months. I called Texas & spoke to this woman Vickey 3 weeks ag. I cried to her about all the deception, lies, corruption. I told her i have issues with my heart & health & going trough all that they have put my husband & i through has added to mt medical issues to my heart. She saidbring everything back now. I will let them know you will be there shortky. We brought it all back within the hour. They put us through hell for 5 hours that day & told us they dont take back any of there furniture, yet they took back all 5 book units. Then they told us to get off their property they called the police to remove us or arrest us. This is insane. Then my husband called them and this women said Vickey had no authority to tell us to bring back everything. She said once you received your furniture we dont take it back, no matter what the condition is. Its yours. So all the furniture we received is destroyed and is garbage. They tell you they will replace the furniture and came with an exchange for the outoman and couch… The furniture must of come from another unsatisfied customer. Ashley furniture plays the game of replacing the furniture from someone else who was disatisfied and will playing russian roulette until someone just excepts there garbage. We were billed $ 4500 over the original price of $2000. They refuse to correct the error on billing. They need to refund us for the 5 book cases we brought back. They also over charged us from the original agreed amount. We have exhausted ourselves in arguing with them for 6 months and want them to take back all there furniture, however they say we do not take the furniture back. Once its in your house, whether there is an issue or problem it is yours. They will not refund you and play the same game with all there other customers in playing the game of replacing the furniture with some all the other disatisfied customers. I put an ad on Next Door, Craigs list to see how many people have has issues with Ashley Furniture? The response was unlimited and it goes on and on. Please add us to this lawsuit.

Did me, please. I bought a sofa, chair an ottoman for $1300. It took from June to November to arrive. It already sinking down where I sit the most after five months. Ashley sends advertising to my home, which I relied on for quality. I notice on every advertisement I receive in the mail that they advertise 60% off, causing the savings to be much greater than they actually are, and the furniture is is only fair quality at best

We purchased 2 loveseats and an oversized recliner. We actually got the furniture in before the original 12 to 20 weeks date they gave us. However, 2 days after delivery we went back to the store in Prattville, AL and stated there were some problems with the love seats not be correctly put together with a console in the middle. We were told that a tech would contact us within a week to come out and fix it. That took 3 weeks before he showed up and told us that Ashley’s furniture was crap and the best thing to do was ask for replacement pieces or a refund. We requested a refund and was told that they don’t do returns. Also said the tech wrote in his report that there was nothing wrong with the furniture. We have pictures to prove furniture is not setup right. Please include me in the lawsuit.

We purchased a sectional when it came and it was unpacked the ottoman needed to go back to be repaired and was told it would take at least a month if they had to we decided to keep the ottoman and wait for the replacement it took longer than they said so we went to the store and talked with the manager and spied the same one on the floor so he sentus home with the one off the floor.

I’m in Indiana & same thing plus within weeks it started falling apart. They sent out a contracted company to come fix it & they didn’t have everything needed. Other company came again & still needed more. I complained many times over everything & Ashley did nothing. Except say sorry nothing more they could do. They ordered more parts that came to my home and sat for months due to covid started. During which I called more times to see when coming back to finish and to this day they have never sent anyone to finish it nor do anything to compensate for it all. It got so bad we had to get rid of the furniture and family gave us some to use. I’m still trying to get something done about it. Please help! I have pictures.

Where in Indiana? We ordered our dining room set from Ashley in Indiana and it came damaged and they promised us that they would send the parts to fix it and we would have to put it together. We have yet to receive the parts. They are saying they are back ordered and we are assuming that everybody who purchased those dining room tables having the same issues because it was very poorly made. We were promised the dining room set by January, which was why we went with Ashley rather than going with another company and we just got it a month ago. We still have not received the two accessory‘s that we ordered with it which was part of the dining room set and those are back ordered until May .
